Terms and Conditions (GTC)

1. General

These conditions apply to all transactions, contracts and offers, such as services and the sale of products, that come into being or are concluded between Nagelstudio Handwerk (Anna Mazanek) and the customer. Exceptions to transactions that do not fall under the general terms and conditions must be communicated in writing. As soon as an appointment is agreed (whether by telephone or in writing), the following terms and conditions are deemed to be accepted.

2. Service

Nagelstudio Handwerk carries out its service to the customer to the best of its knowledge and belief and in accordance with the latest industry standards. If changes to the standards occur, Nagelstudio Handwerk will inform the customer before the service begins.

3. Appointment and cancellation conditions

All Nagelstudio Handwerk customers have the opportunity to make appointments directly in the studio, by phone, SMS, WhatsApp or Facebook. Appointments are binding and must be adhered to. If the customer needs to cancel or postpone a confirmed appointment, the customer must communicate this in good time - at least 24 hours before the appointment - via the channels mentioned above. The customer is also expressly requested to arrive punctually at the agreed time. The appointment will expire if the customer does not arrive 10 minutes after the appointment. Existing customers: If the appointment is not canceled within the above-mentioned period, Nagelstudio Handwerk will charge the customer a loss of earnings of €25. New customers: At the first appointment, the customer will record personal information. Depending on the service, a deposit of at least 50% will be charged for the first appointment. The deposit will be retained as loss of earnings if the cancellation is not made in time - at least 48 hours before the appointment - or is not canceled. Prepayment customers: Nagelstudio Handwerk reserves the right, at its own discretion, to classify customers as unreliable. Appointments here are only made against advance payment. Advance payment appointments that are not attended or not canceled in a timely manner – at least 48 hours before the appointment – ​​include a 100% cancellation fee.

4. Prices and payment deadlines

Due to the small business regulations, all prices stated are final prices. The prices for services and products must be published in the studio. Price increases must be announced at least 30 days before they take effect. Offers are only valid during the published period and are only valid while stocks last. The customer must pay in cash and in EUR immediately after the treatment or directly when purchasing the service or product. Credit cards or debit cards cannot be accepted. If the amount cannot be paid in cash immediately for various reasons, an invoice will be issued. The customer has time to pay this within 7 days. Open claims are handed over to a lawyer.

5. Photos and videos

The customer agrees that the resulting photos and video recordings will be used and published for a variety of presentation purposes and commercial purposes.

6. Personal Information and Privacy

The customer assures that all personal data and information that is relevant for the professional treatment of the requested service will be passed on to the studio or the service provider. This data is stored on the customer file card in written or electronic form. Nagelstudio Handwerk undertakes to use this data only for the purpose of the service to be provided, taking into account the data protection clauses, and not to pass on the data to third parties or outside persons without the written consent of the customer.

7. Confidentiality

Nagelstudio Handwerk is obliged to keep all information discussed during the treatment or service secret and treat it confidentially. Confidentiality will be overridden if this is decided by law and Nagelstudio Handwerk is released from the confidentiality clause.

8. Training and right of withdrawal

Consumers have the right to cancel a training registration within 14 days without giving reasons. The cancellation period is 14 days from the day the contract is concluded. In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email).

9. Liability

The customer waives any claims for damages and recourse against Nagelstudio Handwerk and the service provider and releases them from any responsibility with regard to the (medical) consequences of the treatment resulting from circumstances that were not disclosed. Nagelstudio Handwerk cannot accept any liability if the customer is harmed by a service that is based on information provided by the customer and this turns out to be inadequate. This refers primarily, but not exclusively, to physical conditions, medical or medication requirements or activities outside the studio. Nagelstudio Handwerk is not responsible for the loss or destruction of the customer's personal belongings that were brought into the studio.

10. Damage and Theft

Nagelstudio Handwerk has the right to demand compensation for all damage caused by the customer. Shoplifting will be reported.

11. Warranty

The customer receives a guarantee of 5 working days on the service provided by the Handwerk nail studio. The guarantee does not apply to broken, torn or bitten nails, but to the durability and liability of the material (e.g. liftings). This guarantee expires if: The customer has the modeling treated or filled by a third party or changes something to the original modeling condition themselves. The customer expressly requests a different way of working. The customer comes into contact with aggressive chemicals without using gloves. The customer treats or removes the modeling improperly. For minors and nail biters.

12. Complaints and Complaints

If the customer has a complaint or complaint about the service or the purchased product, this must be reported to the service provider no later than 3 days after the reason for the complaint has been identified. Nagelstudio Handwerk must provide an acceptable solution within the following 5 working days to resolve the complaint. If a complaint is justified, Nagelstudio Handwerk must carry out the complained work again without additional payment or replace the complained product. If the complaint is not resolved to the customer's satisfaction, this can also be decided by an arbitration board or court.

13. Nail Art

When Nail Studio Craft publishes nail art examples in the studio, this is just an example. Even if the design is reworked on the customer, there may be deviations in the shape and effect of the design. The result may differ from the template shown. The copyright for the design remains with Nagelstudio Handwerk. If the customer has photographs taken of the design that is to be used for commercial purposes, this requires the written consent of the nail salon Handwerk or the nail designer. In the event of failure to do so, the studio may assert appropriate claims.

14. Behaviors

The customer undertakes to display appropriate behavior during his visit to the studio. If the customer continues to fail to behave appropriately even after a warning, the nail salon has the right to expel the customer from the studio and, if necessary, issue a ban on the customer. Early termination of the service does not entail any waiver of costs,

15. Severability clause

Should a provision of this agreement be wholly or partially invalid or later lose its legal validity, this should not affect the validity of the remaining provisions. The invalid provisions will be replaced retroactively by a regulation that is as similar in content as possible and comes closest to the purpose of the intended regulation. The statutory provisions apply in place of the invalid provision.

16. Jurisdiction

For the legal clarification of discrepancies, the place of jurisdiction is the location of the nail salon. Applicable law is determined by local residence.
